Time Off & Leaves: Investigatory and Administrative Leave

Applies to: All faculty and staff

Purpose: To define the conditions for temporarily removing an employee from the workplace

Policy Owner: Human Resources

Revision Dates: April 2021

Last Reviewed: April 2021

Policy

In certain circumstances, the college may decide to remove an employee from the workplace or suspend their duties. When this occurs, the employee will be placed on investigatory or administrative leave.

Definitions

Investigatory Leave

An investigatory leave is used when circumstances warrant removing an employee from the workplace and suspending their duties while the college investigates allegations against the employee. An employee may be placed on an investigatory leave with or without prior written notice. Investigatory leave is not a form of corrective action.

Administrative Leave

An administrative leave is used when the college determines that temporarily removing an employee from the workplace and suspending their duties is in the college’s best interests. An employee may be placed on an administrative leave with or without prior written notice. Administrative leave is not a form of corrective action.

Procedures

Written Notice

If you plan to place an employee on investigatory or administrative leave, you must provide them with written notice. If you haven’t provided the written notice before the leave begins, you must do so no later than three working days after the leave began. The written notice must include the reason(s) for the leave and its expected duration. It should also direct the employee to remain available to speak with college representatives, if necessary, and provide any information requested.

Final Notice

When the college concludes its investigation, the employee will  be notified in writing of the outcome and whether the findings will result in continued employment, corrective action or termination of employment.
